Terms of Use
These terms are a legal agreement between you and Bloombroke ("we", "us", "our"), which runs the website at bloombroke.com (the "service"). They cover the free terminal and the paid Pro plan.
Please read them. They limit what we are responsible for, and they say that the service gives information only, not investment advice.
1. Accepting these terms
You accept these terms when you click ACCEPT on the notice shown on your first visit, when you tick the box to agree at checkout, or when you use the service in any way, whichever comes first. If you do not agree, do not use the service.
The Disclaimer and the Privacy Policy form part of these terms. If they conflict with these terms, these terms win, except that nothing here reduces the warnings in the Disclaimer.
2. Who can use Bloombroke
You must be at least 18 years old and able to enter into a binding contract. You may use the service only where doing so is lawful for you. You are responsible for following the laws that apply where you are. We may refuse or end access for anyone, anywhere, at any time.
3. Information only, not advice
Bloombroke gives general market information for education and entertainment. It is not financial, investment, tax, legal or accounting advice, and it is not an offer, solicitation or recommendation to buy, sell or hold any security, digital payment token or other financial product.
Bloombroke does not hold a licence from the Monetary Authority of Singapore and does not provide any regulated financial service. We do not know your investment objectives, financial situation or particular needs.
Data may be delayed, incomplete or wrong. WHATIF results are hindsight illustrations, and calculators such as AFFORD, LOAN and COMPOUND are rough illustrations. None of them is a prediction. The full Disclaimer applies to everything on the service.
You alone are responsible for your decisions. Get advice from a licensed adviser before you act.
4. Bloombroke is experimental
Bloombroke is an experimental project and may be changed or discontinued at short notice. Section 9 explains what happens to a Pro subscription if we end the service.
5. What you may do
We give you a personal, limited, non-exclusive, non-transferable, revocable permission to use the service in a normal web browser for your own personal, non-commercial purposes, in line with these terms. You may share links to screens and the share images the service makes for you.
6. What you must not do
You must not, and must not help anyone else to:
- scrape, crawl, harvest or copy data from the service by automated means, or access it with bots, scripts or other automated tools, other than a normal search engine indexing public pages;
- call our API routes directly, or put a load on the service that a person using a browser would not;
- resell, redistribute, republish, sublicense or commercially use any data or content from the service, including prices, charts, screens and lists;
- use the service, or anything from it, as the basis for giving advice, recommendations, signals or research to anyone else, or for running or marketing any financial product or service;
- copy, frame or mirror the service, or build a competing product from it;
- reverse engineer, decompile or try to find the source of any part of the service, except where the law allows it despite this term;
- get around rate limits, access controls or payment, share or publish a Pro licence key, or use someone else's;
- probe, scan or test the security of the service, or interfere with or disrupt it, its servers or its data sources;
- upload or send anything unlawful, harmful or malicious, or use the service for any unlawful, fraudulent or misleading purpose;
- pretend to be us or suggest that we endorse you.
7. Third-party data and links
The data on Bloombroke comes from third parties. Current sources include CNBC, Nasdaq, the US Securities and Exchange Commission (EDGAR), the US Department of the Treasury, the Federal Reserve Bank of New York, the Federal Reserve Bank of St. Louis (FRED), Freddie Mac, the US Bureau of Labor Statistics, the European Central Bank via the Frankfurter API, CoinGecko, Cboe, Forex Factory, Yahoo Finance, and news publishers such as CNBC, MarketWatch and Yahoo Finance, whose headlines link to the publisher's own site. Sources may change without notice.
These sources are not our partners. They do not endorse Bloombroke and we do not endorse them. Their data belongs to them and may be subject to their own terms, which you must follow if you use their data. We are not responsible for their data, their sites or their availability.
Links to other websites are there for convenience. We do not control those sites and are not responsible for them, their content or how they treat your data.
8. Intellectual property
The service, its software, design, text, the Bloombroke name and logo, and the share images and certificates are owned by us or our licensors. Third-party data belongs to its owners. Except for the permission in section 5, these terms give you no rights in any of it. If you send us feedback or ideas, we may use them freely, without paying you.
9. Pro subscription
- Price. Pro costs USD 4.20 a month, plus any tax that applies. The price shown at checkout is the price you pay.
- Renewal. Pro renews automatically every month and we charge your payment method at the start of each monthly period until you cancel.
- Cancelling. You can cancel at any time: type PRO and press MANAGE, which opens the Stripe billing portal. Cancelling stops future renewals. Pro keeps working until the end of the period you have already paid for.
- Refunds. Payments are not refundable, and we do not refund part-used periods, except where this section or the law says otherwise. If we discontinue the service, we will cancel all subscriptions and refund the unused part of the current period.
- Price changes. We will give you at least 30 days' notice of a price change before it applies to your subscription. If you do not want to pay the new price, cancel before it starts.
- Payments. Payments are processed by Stripe. Stripe's own terms and privacy policy apply to your payment. We do not see or store your full card number.
- Taxes. Prices may not include taxes such as GST, VAT or sales tax. Where we must charge tax, it is added at checkout.
- Licence key. Pro is tied to a licence key. Keep it secret: anyone who has it can use your Pro access and your synced data. We may replace or revoke a key that has been shared, published or misused.
- Failed payments. If a payment fails, Pro may stop working until the payment goes through.
Nothing in this section limits any right you have under the law that cannot be limited, including under the Consumer Protection (Fair Trading) Act 2003.
10. Changes to the service
We may change, add, remove, suspend or stop any part of the service, including data sources, commands, features and Pro features, at any time and without notice, for example because a source stops or changes its terms. We are not responsible to you for doing so, except for the refund in section 9 if we discontinue the service.
11. Suspension and termination
You may stop using the service at any time, and you may cancel Pro as section 9 describes.
We may suspend or end your access, including Pro, at any time if we reasonably believe you have broken these terms, if the law requires it, or to protect the service, our sources or other users. If we end Pro because you broke these terms, no refund is due. If we end Pro for any other reason, we will refund the unused part of the current period.
Sections 3, 6, 7, 8, 12, 13, 14, 15 and 17 continue after these terms end.
12. No warranties
To the fullest extent the law allows, the service and everything on it are provided "as is" and "as available", with all faults. We give no promise, warranty, condition or guarantee of any kind, whether express, implied or from statute, including about accuracy, completeness, timeliness, reliability, availability, security, quality, fitness for a purpose or non-infringement. We do not promise that the service will be uninterrupted, error-free or free of harmful code.
13. Limits on our responsibility
To the fullest extent the law allows:
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, savings, opportunity, goodwill or data, whether or not we could have foreseen it;
- we are not liable for any trading, investment or other financial loss, or any decision you make or do not make, arising from anything on the service, including data that is delayed, missing or wrong;
- we are not liable for the acts, omissions, data or availability of any third party, including our data sources, Stripe, our hosting providers and the sites we link to;
- our total liability to you for all claims about the service or these terms, in contract, tort (including negligence), under statute or otherwise, is limited to the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the first claim and (b) USD 50.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
14. Indemnity
You agree to indemnify us, and our directors, employees and agents, against any claim, loss, liability, cost or expense (including reasonable legal fees) that arises from your breach of these terms, your misuse of the service or your breach of any law or any third party's rights.
15. Claims and governing law
These terms and any dispute or claim about them or the service, including non-contractual disputes, are governed by the laws of Singapore. The courts of Singapore have exclusive jurisdiction.
Before you start any legal action, please write to us at [email protected] and give us 30 days to try to resolve the problem. To the extent the law allows, any claim must be brought within one year after the facts giving rise to it first arose.
16. Changes to these terms
We may change these terms. The version number and the date at the top of this page show which terms apply. If a change is significant, we will ask you to accept the new terms on your next visit, and Pro subscribers may also be told by email. The new terms apply from the date shown. If you do not agree to them, stop using the service and cancel Pro. Continuing to use the service means you accept them.
17. General
- Entire agreement. These terms, with the Disclaimer and the Privacy Policy, are the whole agreement between you and us about the service. You have not relied on any statement that is not in them.
- Severability. If a court finds any part of these terms invalid or unenforceable, that part is changed as little as needed to make it enforceable, and the rest stays in force.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Transfer. You may not transfer your rights under these terms. We may transfer ours, for example if the service is sold, and we will tell Pro subscribers if we do.
- Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control, including failures of data sources, networks or providers.
- Third parties. Only you and we have rights under these terms. No one else may enforce them under the Contracts (Rights of Third Parties) Act 2001.
- Language. These terms are written in English. A translation is for convenience only.
